Apple Forced to Pay Samsung's Legal Fees in the UK Over Apology ...

Unlike in the US, Apple was handed a resounding defeat during its legal truffle with Samsung in the UK. Unfortunately for Apple however, the judge did a bit more than throw the case out. Judge Robin Jacob ordered the company to publically apologize to Samsung on the front page of its website, and gave them a tight timeline to comply. How did Apple respond? First they posted a halfhearted apology, then when the judge ordered them to try again, they used a bit of web trickery to hide the proper apology, regardless of browser type or resolution. The judge as you could imagine, was not impressed.

The Court of Appeal has now ordered Apple to pay all of Samsung?s legal fees on an ?indemnity basis?, and is no doubt hoping it will properly humiliate the company over all the hassle. Apple was already most likely on the hook given the defeat, but the indemnity ruling will make this an even more expensive experiment for Apple.?

Apple?s attempt to cover up the verdict didn?t just shine a broader international spotlight on the issue, it also kept the verdict in the news cycle weeks longer then it would have otherwise. We appreciate the irony of watching a company that is renowned for its ability to control the media, fail so miserably.?

This story is basically about good vs bad, nature vs man sort of...a fantasy story in a fantasy world.

A chemical released by a plant or in the air is altering the mind of humans and animals/creatures. It is causing them to be violent, turning them into monsters. Through out this man kind has managed to survive, with trained forces and bounty hunters. Man and other races have learned to harness energy in its many forms. This has caused them to let's say, light up a saber with electricity or make bows of arrows of light.

When I say other races, I am referring to any humanoid creature. Meaning elves, dwarves, a reptile-man race, etc.

Now this takes place in 2600 AS, after shadow. We're on an earth like world called Terra with earth like creatures, the only difference is some of these creatures have gone haywire. They've become no longer animal or human any longer. Something inside these few creatures such has genes etc. are susceptible to this chemical that is turning them into monsters. Sad but true in the story.

Some spots in the world are places where these monsters gather together. If wanted, I could make a map, but I don't think a map would cover all of this world. So...

This world is open as in you can make up a town or village you've come from, or city. The world is not very urban, but it's more spaced out. For instance my character comes from Newberg, a town that sits in the valley of twin mountains.

One thing is for certain: We are all to meet up coincidentally at a sanctuary ruin. I'll add more to this if you're interested, answer questions in the OOC or here, etc.

Obama: Americans agree with my debt plan

WASHINGTON (AP) ? President Barack Obama, laying down his marker for grueling "fiscal cliff" negotiations, said Friday he won't accept any approach to federal deficit reduction that doesn't ask the wealthy to pay more in taxes.

"This was a central question during the election," Obama said in his first postelection comments on the economy. "The majority of Americans agree with my approach."

The president, speaking in the White House East Room, said he wasn't wedded to every detail of the plans he outlined during the election, adding, "I'm open to compromise." But he offered no indication that he was willing to back down on his insistence that the wealthy pay more.

Republicans stood their ground. At the Capitol, Republican House Speaker John Boehner said he remains unwilling to raise tax rates on upper-income earners. But he left open the possibility of balancing spending cuts with new revenue that could be achieved by revising the tax code to lower rates and eliminate some tax breaks.

Obama said he had invited congressional leaders of both parties to the White House next week to start negotiations on averting the tax increases and automatic spending cuts due to hit in January. Both parties agree that those changes, the result of failed deficit-cut talks earlier this year, could send the economy back into recession.

The president avoided any mention of specific tax rates in his remarks, saying only that the wealthy should pay more. He also called on Congress to quickly pass an extension of tax cuts, first enacted by George W. Bush, for families making less than $250,000 a year.

Republicans, as they have throughout Obama's first term, say raising tax rates on wealthier Americans is a non-starter. Boehner said such increases would hurt small businesses just as they are trying to recover from the severe last recession.

"I'm proposing that we avert the fiscal cliff together in a manner that ensures that 2013 is finally the year that our government comes to grips with the major problems that are facing us," the speaker said. He said cuts to Medicare, Medicaid and food stamps, known as entitlement programs, have to be part of the equation.

Still, Boehner declined to provide specific proposals to avoid the fiscal cliff.

He did say that raising the debt limit, which the government will reach sometime in the spring, should be part of any negotiations. Pressed for details beyond that framework, he said he didn't want to limit ideas to address the problem. He burden is on Obama, he said.

"This is an opportunity for the president to lead," Boehner said. He repeated a version of that phrase four times during the 11 minutes he spoke. "This is his moment to engage the Congress and work toward a solution that can pass both chambers."

Movies about wayward kids are a European specialty. The new film "Sister" deepens the specialty.

The influence of Belgian masters Jean-Pierre and Luc Dardenne's documentary eye for youth on the margins is evident in Ursula Meier's calmly heartbreaking drama.

It's a terrific, bracingly sad movie.

Emotionally engaging and impeccably crafted

Klein and Seydoux give such naturalistic performances that they're never overwhelmed by the spectacle.

"Sister" is loose and episodic, but held together with nicely sketched characters.

[A]voids bathos. . .reveals unexpected depth in a heartbreaking bond. . . Different classes conflict [in] adjacent spaces . . .in spare, realistic Dardennes' style.

Meier draws out wonderfully naturalistic performances from her young stars, with Mottet Klein particularly good as the young roustabout Simon ...

It comes over like a subtle short story and is well acted.

Meier's portrait of Simon ... is richly atmospheric and never sentimental.

An enigmatic, heartfelt account of a vulnerable young boy's yearning for a better life.

Most intriguing is how the writers and director have transformed what's essentially a rather dark, bleak story into something involving and emotionally resonant, all without ever turning sentimental.

It is an interesting and well-made movie, though with an uncertain ending.

Sister gradually reveals pattern in its tapestry of everyday life.

An expert piece of storytelling with a host of strong character turns and thematic depth to burn.

A healthy seam of mischief helps cut through the occasionally rote social comment.

An emotionally engaging, beautifully shot and impressively directed Dardennes-esque French drama with a superb script and excellent performances from Kacey Mottet Klein and L?a Seydoux.

An unusual, involving, slightly strained character study from Ursula Meier, the French director of 2008's satirical dystopia, 'Home'.

Hungary says EU cut in its funds would be a shame

BUDAPEST (Reuters) - The European Union risks undermining the credibility of its drive against national budget overshoots if it strips Hungary of structural funds as punishment for running an excessive deficit, a leader of the ruling Fidesz party said.

The EU is due to unveil its assessment of Hungary's latest deficit-cutting measures on November 7, which could be the basis of a cut in funds and can also influence Hungary's credit talks with Brussels and the International Monetary Fund (IMF).

Lajos Kosa, a Fidesz vice chairman was quoted on Saturday by the daily Magyar Nemzet as saying that the government had implemented tight fiscal policy since it was elected in 2010, and a cut in funds would be "a shame".

"If they do (cut funds), that will have an amazingly bad message in the entire Union which is cracking anyway even without that," Kosa said.

While Kosa is regarded as the most outspoken of Fidesz's leaders, the government's tendency to talk tough about Brussels and the IMF at home has bolstered expectations that talks over an international aid deal will eventually fall apart.

Kosa repeated in the interview that Hungary needed an IMF deal but analysts in a recent Reuters poll saw only a 50 percent chance, judging that a more positive mood to global markets has eased pressure on the government's borrowing costs.

Two deficit-cutting packages that Hungary submitted to Brussels in the past weeks included a further rise in taxes on banks and the government has said that burden can even grow if the EU wants more measures.

The central bank and international analysts have said that the heavy taxation on banks hinders recovery from recession and IMF spokesman Gerry Rice said on Thursday that Hungary needed a change in attitude for the talks to go on.

Flooded subways may pose biggest threat to recovery

NEW YORK (AP) ? The floodwaters that poured into New York's deepest subway tunnels may pose the biggest obstacle to the city's recovery from the worst natural disaster in the transit system's 108-year history.

Critical electrical equipment could be ruined. Track beds could be covered with debris. Corrosive salt water could have destroyed essential switches, lights, turnstiles and the power-conducting third rail.

Several of the tunnels that carry cars and subway trains beneath New York City's East River remained flooded Tuesday. The head of the Metropolitan Transportation Authority said it was too early to tell how long it would take to pump them dry and make repairs.

There has always been flooding in the tunnels, which collect storm water constantly, even in the lightest of rains. But authorities said there has never been anything like the damage inflicted by Hurricane Sandy. The South Ferry subway station, at Manhattan's southern tip, had water up to its ceiling.

The high water meant inspectors weren't immediately able to assess how badly the water had damaged key equipment, raising the possibility that the nation's largest city could be forced to endure an extended shutdown of the system that shuttles more than 5 million riders to work and home every day.

Mayor Michael Bloomberg guessed it could take four days for train service to resume. And even then it was unclear how much of the nation's largest public transit system would be operational.

"If there are parts of the subway system we can get up, we will get them up," MTA Chairman Joseph Lhota said. But he suggested that, for a time, the system would be a patchwork, with buses filling in many of the gaps. Buses resumed operations Tuesday evening. Fares were being waived through Wednesday.

Experts suggested that the cost of repairs could be staggering.

A report released last year by the New York State Energy Research and Development Authority estimated that a flood roughly comparable to the one that hit the city Monday night would do $10 billion in damage to the transportation infrastructure and cause another $40 billion in economic losses due to the paralyzing effects of a crippled transit system.

Klaus Jacob, an environmental disaster expert at Columbia University who oversaw the portion of the report dealing with transit disruptions, said the study estimated that it would take four weeks to get the subway system back to 90 percent of normal capacity.

"I'm not saying that this is definitely what is going to happen here," he cautioned.

But he said the transit authority's challenges are severe.

"In the tunnels under the East River, all the signal-and-control systems are underwater. And it is salt water," he said. "It's not just that it doesn't work right now. It all has to be cleaned, dried, reassembled and tested. And we are not sure what the long-term corrosion effect might be."

At the time of the study, he said, the MTA also had only a fraction of the large pumps it would need to get major floodwaters out of train and vehicle tunnels quickly.

The study looked at the kind of flood that the Federal Emergency Management Agency estimates would only strike the city every 100 years.

This week's storm, he said, illustrates the pressing need for better defenses against the higher water levels that will come with a warmer planet.

"I think we have come to the end of studies. What we need now is action," he said.

Some authorities were contemplating the same ideas.

"We have to start thinking about how we redesign the system so this doesn't happen again," Gov. Andrew Cuomo said. "I don't think anyone can sit back anymore and say, 'I'm shocked at this weather pattern.' There is no weather pattern that can shock me anymore."

Seven subway tunnels and two vehicular tunnels took on massive amounts of water during the night as the rivers that surround Manhattan rose to record levels. Nearly 4,000 feet of the Brooklyn-Battery Tunnel remained heavily flooded Tuesday morning. Water also poured into the Queens-Midtown Tunnel across the East River. Floodwaters also inundated parts of the PATH system that brings commuters from New Jersey to the World Trade Center site and midtown Manhattan.

The river tunnels that allow Amtrak trains to connect with New York City also filled with an "unprecedented" amount of water, railroad officials said in a statement.

Amtrak planned to offer modified service between Newark, N.J., and points to the south on Wednesday, but officials could offer no timetable for restoring trains into Manhattan. No trains were running between Boston and New York.

The Holland Tunnel, one of only three ways to get across the Hudson River to New Jersey from Manhattan by car, remained closed as well, with no date for reopening.

The subway system has built-in pumps that typically remove 13 million gallons of water from the tubes across the city. Special pump trains were being deployed to handle the extra load.

The MTA cut power to tracks before the flood, hoping to minimize damage, but until the tunnels and stations are dry, inspectors won't know if the precautions worked.

"We'll find out. But right now, we just don't know," said Charles Seaton, an MTA spokesman.

Water in the two vehicle tunnels receded slightly as the tide fell Tuesday morning, but the massive pumps that will eventually empty the tubes were unable to immediately make headway because the places where they normally send water ? the river and sewer system ? remained so high, the outflow pipes in the pumping system were still submerged.

"Our pumps are working. It's just that the water has no place to go," MTA spokeswoman Judy Glave said. "We pump it out and it just comes back in."

Pasquale DiFulco, a spokesman for the Port Authority of New York and New Jersey, offered no estimate on how long it might be before the PATH commuter rail lines reopen.

"We're still trying to assess what happened," he said.

Most of the city's bridges did well during the storm and reopened Tuesday when the wind died down. One of the two bridges leading out to the ravaged Rockaway barrier islands remained closed because of flood damage in the surrounding neighborhoods. A train causeway to the Rockaways also remained closed because of flooding.

There were other problems in the transportation system. Some rail yards and bus garages took on water. Sludge and debris covered some tracks. Trees blocked bus routes. Workers will need to walk hundreds of miles of track on foot to search for damage. At least 40 Long Island Rail Road power stations lost electricity, and the overhead power lines that allow Metro-North trains to operate were damaged in several areas.

One diesel-powered patrol train inspecting the Metro-North's Hudson line, which runs north along the Hudson River, found a 40-foot boat blocking the tracks in Ossining, N.Y., officials said.
