AP Interview: JC Penney CEO talks about the chain

NEW YORK ? Everyone in the retail world wants to see if Ron Johnson can work his magic a third time.

For 15 years, he helped shape Target's cheap chic image. Then, he spent about a decade changing the way Americans shop for electronic gadgets at Apple.

Now, Johnson faces perhaps his biggest challenge yet as CEO of J.C. Penney: Dust off one of the dowdiest brands in retailing to make it cool again. To do that, he's borrowing from Apple's uber-successful playbook.

During an hour-long interview in which he talked about how he planned to transform Penney, the 52-year-old mentioned Apple 19 times. Like he did at Apple, the 30-year retail industry veteran says he plans to change the shopping experience, shun heavy discounting and sell services along with products.

25 EU nations to sign treaty to stop overspending

BRUSSELS ? All countries in the European Union, except Britain and the Czech Republic, agreed Monday to sign a new treaty designed to stop overspending in the eurozone and put an end to the bloc's crippling debt crisis, while also pledging to stimulate growth across the region.

The new treaty, known as the fiscal compact, was agreed to at a summit of European leaders in Brussels. It includes strict debt brakes and makes it more difficult for deficit sinners to escape sanctions. The 17-country eurozone hopes that the tighter rules will convince investors that all countries will get their debts under control and restore confidence in their joint currency.

Although the new rules only apply to the 17 euro states, the currency union was hoping to get broad support from the other EU states.

The summit also promised Monday to stimulate growth and create jobs across the region, in a tacit acknowledgment that their exclusive focus on austerity has had painful side effects.

Incomes up strong 0.5 pct., consumer spending flat

WASHINGTON ? Americans' income rose in December by 0.5 percent, the most in nine months, a hopeful sign for the economy after a year of weak wage gains. But consumers didn't spend any more last month than they had in November.

Americans ended up saving their additional income.

Economists noted that income rose last month largely because of strong hiring. The economy added 200,000 jobs in December. More jobs mean more income available to spend.

The best hope for the economy is further job gains. On Friday, the government is expected to report another solid month of hiring for January.

For all of 2011, income barely rose.

WTO: China unfairly limits export of raw materials

The World Trade Organization ruled Monday that China unfairly limited exports of nine raw materials to protect domestic manufacturers.

A WTO appeals body rejected China's appeal of an earlier ruling in July that concluded the Asian economic powerhouse had violated international trade rules. The appeals body largely sided with the U.S., European Union and Mexico, which had taken issue with Chinese restrictions on its exports of nine materials used widely in the steel, aluminum and chemical industries.

The ruling affects China's exports of certain forms of bauxite, coke, fluorspar, magnesium, manganese, silicon carbide, silicon metal, yellow phosphorous and zinc. The WTO appeals body says China must now "bring its export duty and export quota measures into conformity with its WTO obligations."

Tech companies team up to combat email scams

NEW YORK ? Google, Facebook and other big tech companies are jointly designing a system for combating email scams known as phishing.

Such scams try to trick people into giving away passwords and other personal information by sending emails that look as if they come from a legitimate bank, retailer or other business. When Bank of America customers see emails that appear to come from the bank, they might click on a link that takes them to a fake site mimicking the real Bank of America's. There, they might enter personal details, which scam artists can capture and use for fraud.

To combat that, 15 major technology and financial companies have formed an organization to design a system for authenticating emails from legitimate senders and weeding out fakes. The new system is called DMARC ? short for Domain-based Message Authentication, Reporting and Conformance.

Stocks and bond yields drop on Europe worries

NEW YORK ? The wait for an expected deal between Greece and its creditors rattled financial markets around the world Monday. Yields for ultra-safe U.S. government debt hit their lowest this year, the euro dropped against the dollar, and European stocks fell.

U.S. stocks dropped slightly, with the Dow Jones industrial average off 0.1 percent.

Borrowing costs for European countries with the heaviest debt burdens shot higher. The two-year interest rate for Portugal's government debt jumped to 21 percent after trading around 14 percent last week.

Greece and the investors who bought its government bonds were said to be close to an agreement that would replace bonds held by investment funds and banks with new ones at half the face value.

Starbucks, Tata to open 50 Indian stores this year

MUMBAI, India ? Starbucks aims to open 50 outlets in India by year's end, through a 50-50 joint venture with Tata Global Beverages, the companies said Monday.

Tata Starbucks Ltd., as their venture is known, hopes to capitalize on the rising aspirations ? and fattening wallets ? of many Indians, who are eager to partake of the global latte life.

The first outlet will open in Mumbai or New Delhi by September.

Wendy's CEO: Our wounds were 'self-inflicted'

NEW YORK ? Wendy's new CEO on Monday called the dour results of the past few years "self-inflicted wounds" and vowed to do better, laying out plans that included hiring top-tier workers and reclaiming market share from higher-end competitors like Five Guys and Smashburger.

Emil Brolick, the CEO since September, told investors that he was intent on winning back customers jaded by a stale menu and inconsistent service, as well as investors, who have grown weary of "a little bit of overpromising and under-delivering."

And rather than blaming the struggling economy for the revenue declines and quarterly losses of the past few years, Brolick said that the company's problems were its own fault.

Gates Foundation, drug makers push on tropical ills

Thirteen major pharmaceutical companies, government groups and health charities will work together in a push to eliminate or control by 2020 10 tropical diseases that affect more than a billion people in poor countries.

The partners, including the Bill & Melinda Gates Foundation, call it the largest coordinated effort ever to combat neglected tropical diseases. The government groups and charities alone are committing just over $785 million in new funding.

The drug makers are donating billions of doses of their medicines over the rest of the decade, but did not attribute a value to them. The companies also will work together to speed up development of new treatments, and the partners will work on improving drug delivery and treatment programs, including prevention and education.

The Dow Jones Industrial average fell 6.74 points to close at 12,653.72, for a drop of 0.1 percent. The Standard & Poor's 500 index fell 3.32 points, or 0.3 percent, to 1,313.01. The Nasdaq composite lost 4.6 points, or 0.2 percent, at 2,811.94.

Benchmark crude fell by 78 cents to finish at $98.78 per barrel in New York on Monday. Brent crude, which is used to price foreign oils that are imported by U.S. refineries, lost 71 cents to end at $110.75 per barrel in London.

Heating oil fell 2 cents to finish at $3.05 per gallon and gasoline futures fell 6 cents to end at $2.87 per gallon. Natural gas futures fell 4 cents to end the day at $2.71 per 1,000 cubic feet.

France brings Armenian genocide bill one step closer to law

The French Senate today approved a controversial bill making it a crime to deny the Armenian genocide in what many see as a political ploy ahead of elections this spring.

France poked Turkey in the eye last night by approving a new "genocide denial" bill, then this morning urged Turkey to ?remain calm.?

But Turkish reaction was not especially calm.

After the French Senate voted in the late hours Monday to criminalize a denial of the 1915 Armenian genocide ? punishable with a year in jail and a $58,000 fine ? Turkey?s ambassador to France said he will leave.

Prime Minister Recep Tayyip Erdogan today called the new law ?discriminatory? and ?racist? and a ?massacre of free expression,? and pointed out that French President Nicolas Sarkozy?s ancestors had once sought refuge in Turkey.

Something?s definitely out of whack in this diplomatic fallout. But it isn?t entirely Turkey?s inability to face its Ottoman past, which includes the killing or deporting of some 750,000 to 1.5 million Armenians during World War I.

Even French Foreign Minister Alain Juppe, a member of the ruling party, thinks the new French law is a bad idea and ?ill-timed.?

?I?m sure we?ll find again a constructive relationship,? Mr. Juppe told French TV. ?I put out my hand and I hope it will be shaken one day.?

In fact, there are actual reasons why Turkey might see fit to remain calm, as Juppe urges. This law really isn?t about Turkey. It?s French politics.

Turkish leaders take the genocide law as a matter of national dishonor and high principles, and point to French slaughters in Algeria, and speak of rights, including of independent thought, that France champions. It is highly emotional.

Yet in France the new genocide law is seen with considerable cynicism, and with little emotion or much regard. It comes just ahead of national elections this spring. Along with its slightly craven appeal to the hundreds of thousands of French-Armenian voters, for whom the issue has always been a defining one, the law also gives President Sarkozy a way to remind conservatives that he?s against a Muslim country joining Europe.

Mr. Sarkozy has a problem with a poll-surging Marine Le Pen of the far-right National Front, who accuses him of overseeing an ?Islamization? of France.

The bill is "not entirely free of ulterior electoral motives considering that there is a 500,000-strong French Armenian community in France," as the French daily Liberation put it.

French politicos have portrayed their new legal concoction as part of a long, historic fight against a ?poisonous denial? by the human race of various mass murders.

'House Of Lies': Kristen Bell Talks Character Reveal

On Showtime's "House of Lies," the characters aren't opposed to breaking more than a few social standards in an effort to get the job done.

In the fourth episode of Season 1, "Mini-Mogul" (airing Sun., Jan. 29 at 10 p.m. EST), for example, Jeannie Van Der Hooven says goodbye to her fiance in the airport and promptly removes her engagement ring before meeting up with the rest of "the Pod."

In December, "House of Lies" star Kristen Bell, who plays Jeannie, told HuffPost TV that her character "doesn't have the strongest moral compass;" but in Jeannie's mind, she's not doing anything wrong.

[Laughs] When you were reading the script, were you kind of appalled at anything she does?
I wasn't appalled because I was reading from her perspective -- my only goal is to believe everything she does and then display it for the audience, present it for the audience. Jeannie was a big player born into a really small game and that's what she's running from. She desperately wants to be an adult, which causes her often to act like a child. She has not really had a set of consequences that has ever forced her to reconcile her actions with her values, so she'll continue to do what satisfies her ... I guess what I'm saying is she doesn't think taking off her ring is all that wrong. She looks at it from the perspective -- most people can look at it with empathy and say, "Well, this is disrespectful to her husband." Jeannie is simply looking at where, "I don't want the men at work to know I'm engaged because being single and being sexy gives me a leg up." It's as simple as that.

It's similar to celebrities who don't talk about their personal lives.
Kind of, yeah. There's the addition of once you pop that can open, everybody wants to know everything about the lint between your toes. But yeah, I think that is definitely a part of it. You feel more in control and you have a little bit more power when you are fiercely protective of your private life. Granted, it doesn't really work out all that well for Jeannie as you'll see in the unfolding episodes.

Putin critics take to cars to demand fair elections (Reuters)

MOSCOW (Reuters) ? Critics of Prime Minister Vladimir Putin drove in their hundreds around central Moscow on Sunday in cars trailing white ribbons, a symbol of Russia's protest movement, staging a mobile demonstration to demand fair elections.

Opposition leaders are trying to maintain momentum after tens of thousands of people angry over alleged election fraud and Putin's plan to return to the Kremlin in a March vote turned out last month for the biggest protests of his 12-year rule.

"This has an important symbolic meaning. We have arrived at the stage when we don't want to be vassals any more," said opposition activist Ilya Ponomaryov, who picked up hitchhikers with white ribbons in his purple sedan.

Organizers said the demonstration also aimed to advertise protest marches planned for next Saturday, exactly one month before the March 4 presidential election.

"We want to show our unity. This is very visible. This is preparatory work for February 4, when there will be even more people than on Sakharov Avenue," Ponomaryov said, referring to the site of a December 24 rally that drew tens of thousands.

Polls indicated Putin will regain the presidency, extending his rule for at least six more years. He was president from 2000-2008 and is widely believed to have been holding Russia's reins for his protege, President Dmitry Medvedev.

Some drivers resorted to white construction tape, printer paper, grocery bags and even white lace as they cruised around Moscow's Garden Ring road. Organizers said more than 3,000 motorists took part, while police put the number at about 300.

In the minus 15 C (5 F) chill, many pedestrians applauded or waved white handkerchiefs from the sidewalks in solidarity. One vehicle had a life-sized straw figure with a picture of Putin's face strapped to its hood.

Cars are a strong symbol not only of status but of personal freedom in Russia and the right to choice in a country where even ownership of a tiny Soviet-made Lada was a luxury in the communist era and foreign cars were virtually non-existent.

The protests, provoked by widespread suspicions of fraud favoring Putin's ruling party in a December 4 parliamentary election, have revealed dismay among Russians.

Middle-class city dwellers in particular feel they have no say in politics and that Putin's decision to return to the Kremlin was thrust upon them.

"We have to fight for our rights... We have to show our strength so that maybe people will see us and come to the February 4th protest," said Nadezhda, 26, who works for a state TV station. Nadezhda, who declined to give her last name, said her station had told employees not to take part in Sunday's protest.

"I feel cheated by the vote," Yevgeny Starshov, 23, a student at a state school of public administration, said of the parliamentary election.

"We have to do something to change the country for the better, not through riots or some kind of revolution but through such peaceful demonstrations to fight for more fair elections."

Thousands of Putin's supporters rallied on Saturday in Yekaterinburg, Russia's fourth-largest city, to back his election bid.

FedEx employee charged for bomb joke on Army base (AP)

SALT LAKE CITY ? Prosecutors in Utah charged a FedEx Corp. driver with a threat of terrorism count over allegations he joked that a package he was delivering to a Utah Army base was likely a bomb.

Charges filed this week in Salt Lake City show the deliveryman was dropping off a package on Sept. 20 addressed to an Army Corps of Engineers employee at Camp Williams.

Prosecutors say that when a woman asked him what it was, he replied that it was probably a bomb. Military police then evacuated 215 people from the building and the surrounding area.

The Deseret News identified the driver as 27-year-old Kevin Coleman.

Police say the man later told them his comment was a mistake.

He's charged with a third-degree felony count of threat of terrorism.

Romney is the aggressor in final Florida debate (AP)

JACKSONVILLE, Fla. ? An aggressive Mitt Romney repeatedly challenged Republican rival Newt Gingrich Thursday night in the final debate before next week's critical Florida primary, demanding an apology for an ad saying he harbors anti-immigrant sentiments and ridiculing the former House speaker's call to colonize the moon.

"If I had a business executive come to me and say I want to spend a few hundred billion dollars to put a colony on the moon, I'd say, `You're fired,'" Romney declared. That was just one particularly animated clash between two rivals struggling for supremacy in the race to pick an opponent to President Barack Obama in the fall.

Gingrich responded heatedly. "You don't just have to be cheap everywhere. You can actually have priorities to get things done." He said that as speaker of the House he had helped balance the budget while doubling spending on the National Institutes of Health.

The debate was the 19th since the race for the Republican nomination began last year, and the second in four days in the run-up to Tuesday's Florida primary. Opinion polls make the race a close one ? slight advantage Romney ? with two other contenders, former Sen. Rick Santorum of Pennsylvania and Texas Rep. Ron Paul far behind.

Gingrich's upset victory in the South Carolina primary last week upended the race for the nomination, and Romney in particular can ill-afford a defeat on Tuesday.

While the clashes between Gingrich and Romney dominated the debate, Santorum drew applause from the audience when he called on the two front-runners to stop attacking one another and "focus on the issues."

"Can we set aside that Newt was a member of Congress ... and that Mitt Romney is a wealthy guy?" he said in a tone of exasperation.

There were some moments of levity, including when Paul, 76, was asked whether he would be willing to release his medical records. He said he was, then challenged the other three men on the debate stage to a 25-mile bike race.

He got no takers.

In the days since Romney's loss in South Carolina, he has tried to seize the initiative, playing the aggressor in the Tampa debate and assailing Gingrich in campaign speeches and a TV commercial.

An outside group formed to support Romney has spent more than his own campaign's millions on ads, some of them designed to stop Gingrich's campaign momentum before it is too late to deny him the nomination.

With polls suggesting his South Carolina surge is stalling, Gingrich unleashed a particularly strong attack earlier in the day, much as he lashed out in Iowa when he rose in the polls, only to be knocked back by an onslaught of ads he was unable to counter effectively.

Thursday night's first clash occurred moments after the debate opened, when Gingrich responded to a question by saying Romney was the most anti-immigrant of all four contenders on stage. "That's simply inexcusable," the former Massachusetts governor responded.

"Mr. Speaker, I'm not anti-immigrant. My father was born in Mexico. My wife's father was born in Wales. ... The idea that I'm anti-immigrant is repulsive. Don't use a term like that," he added.

At the same time, Romney noted that Gingrich's campaign had been pressured to stop running a radio ad that called Romney anti-immigrant after Florida Sen. Marco Rubio called on Gingrich to do so.

He called on Gingrich to apologize for the commercial, but got no commitment.

About an hour later, Romney pounced when the topic turned to Gingrich's proposal for an permanent American colony on the moon ? an issue of particular interest to engineers and others who live on Florida's famed Space Coast.

A career businessman before he became a politician, Romney said: "If I had a business executive come to me and say I want to spend a few hundred billion dollars to put a colony on the moon, I'd say, `You're fired.'"

The audience erupted in cheers, but Romney wasn't finished.

He said the former speaker had called for construction of a new Interstate highway in South Carolina, a new VA hospital in northern New Hampshire and widening the port of Jacksonville to accommodate the larger ships that will soon be able to transit the Panama Canal.

"This idea of going state to state and promising people what they want to hear, promising hundreds of billions of dollars to make people happy, that's what got us into trouble in the first place," Romney said.

Gingrich responded that part of campaigning is becoming familiar with local issues, adding, "The port of Jacksonville is going to have to be expanded. I think that's an important thing for a president to know." He went on to refer to completion of an Everglades project that he did not describe, then noted he had worked to expand NIH while he was speaker.

Gingrich raised questions about Romney's wealth and his investments. "I don't know of any American president who's had a Swiss bank account," Gingrich said. Romney replied that his investments were in a blind trust over which he had no control. "There's nothing wrong with that," declared Romney, who has estimated his wealth at as much as $250 million.

Earlier Thursday, it was disclosed that Romney and his wife, Ann Romney, failed to list an unknown amount of investment income from a variety of sources including a Swiss bank account on financial disclosure forms filed last year. His campaign said it was working to correct the omissions.

Gingrich also failed to report income from his 2010 tax return on his financial disclosure. The former Georgia congressman will amend his disclosure to show $252,500 in salary from one of his businesses, spokesman R.C. Hammond said.

Debating in a state with a large and influential Jewish population, Romney and Gingrich vied to stress their support for Israel rather than criticize one another.

And all four men were quick to name prominent officials of Hispanic descent who deserved consideration for the Cabinet. Gingrich trumped the other three, saying, "I've actually thought of Marco Rubio in a slightly more dignified and central role," an evident reference to the vice presidential spot on the ticket.

Immigration was a recurring theme.

Gingrich said Romney was misleading when he ran an ad accusing the former House speaker of once referring to Spanish as "the language of the ghetto." Gingrich claimed he was referring to a multitude of languages, not just Spanish.

Romney initially said, "I doubt it's mine," but moderator Wolf Blitzer read it aloud and pointed out that Romney, at the ad's conclusion, says he approved the message.

As for immigration policy, it was difficult to discern their differences.

Both men said they want to clamp down in illegal immigration, create programs to make sure jobs go only to legal immigrants and deport some of the 11 million men and women in the country unlawfully.

Gingrich has never said how many illegal residents he believes should be deported, preferring to say that the United States is not going to begin rounding up grandmothers and grandfathers who have lived in the United States for years.

Romney agreed that was the case ? and Gingrich said that marked a switch in position.

"Our problem is not 11 million grandmothers," Romney said. "Our problem is 11 million people getting jobs that many Americans, legal immigrants would like to have."

Romney and Gingrich also exchanged jabs over investments in Fannie Mae and Freddie Mac, two mortgage giants that played a role in the national foreclosure crisis that has hit Florida particularly hard.

Gingrich said Romney was making money from investments in funds that were "foreclosing on Floridians."

Romney quickly noted that Gingrich, too, was invested in mutual funds with Fannie Mae and Freddie Mac. He then added that the former House speaker "was a spokesman" for the two. That was a reference to a contract that one of Gingrich's businesses had for consulting services. The firm was paid $300,000 in 2006.

Pro Bowlers want game to stay in Hawaii (AP)

HONOLULU ? Many NFL stars are hoping that when it comes to the Pro Bowl, aloha doesn't mean goodbye.

The NFL all-star game doesn't have a home beyond Sunday's game. League and Hawaii officials are negotiating a deal to keep the game in the islands, which is hosting it for the second straight year after it was played in Miami in 2010, breaking a 30-year run in Hawaii.

Miami Dolphins receiver Brandon Marshall says the Pro Bowl belongs in Hawaii.

Some players went as far as saying they wouldn't participate if the Pro Bowl was moved.

The state is paying the NFL $4 million per game for the rights to hold this year's game in Hawaii.

(AP) ? A son of the city police commissioner is under investigation by prosecutors and denies any wrongdoing, his lawyer said Wednesday, without elaborating on the allegations.

Greg Kelly, a local television show co-host and a son of Police Commissioner Raymond Kelly, is cooperating with the Manhattan district attorney's office investigation and "strenuously denies any wrongdoing of any kind," lawyer Andrew Lankler said in an emailed statement.

"We know that the District Attorney's investigation will prove Mr. Kelly's innocence," Lankler said. He didn't immediately respond to questions Wednesday night about the focus of the probe.

The DA's office declined to comment. Chief police spokesman Paul Browne said he couldn't comment and was referring inquiries to the DA's office because of the potential conflict of interest.

But Browne said the police commissioner was made aware of an accusation against his son by the boyfriend of a woman claiming the younger Kelly assaulted her, according to reports in the New York Times and Daily News.

"He said, 'your son ruined my girlfriend's life'," the Daily News quotes Browne as relating. "The commissioner said 'Well, what do you mean?' He said he didn't want to talk about it here so the commissioner told him to send a letter."

Greg Kelly, 43, co-hosts "Good Day New York," a morning television show on local Fox affiliate, WNYW-TV. Messages left for the station weren't immediately returned late Wednesday.

He joined Fox News Channel in 2002 and was the White House correspondent from 2005-2007, according to his biography on WNYW's website. A Marine Corps veteran and reservist, he also covered the Iraq War, including four assignments in Baghdad.

Before that, he covered politics for local cable news channel New York 1 and was an anchor and reporter for NewsChannel 34, an ABC and NBC affiliate in Binghamton, N.Y., his bio said.

He also served for nearly a decade in the Marine Corps and is now a lieutenant colonel in its reserves.

Raymond Kelly returned to the police commissioner's post in 2002 after a stint in the 1990s.

(AP) ? Timothy Geithner said Wednesday that he doesn't expect to serve a second term as Treasury secretary. He said he doesn't think President Barack Obama would ask him to remain if Obama won re-election.

"He's not going to ask me to stay on, I'm pretty confident," Geithner said in a Bloomberg Television interview. "I'm also confident he's going to have the privilege of having another Treasury secretary."

Geithner is the only remaining top official on Obama's original economics team. He had considered leaving in August after the congressional battle over raising the debt limit was resolved.

Obama asked him to reconsider and remain in the Cabinet, and Geithner did. But the incident heightened expectations that Geithner would serve only through the 2012 election.

Asked for reaction to Geithner's comments Wednesday, White House spokeswoman Amy Brundage said, "In August, when the president asked Secretary Geithner to remain in his position, Secretary Geithner made it clear he intended to leave after the election and the president understood that decision."

Geithner, who helped lead the administration's response to the 2008 financial crisis, has been a frequent target of criticism in his three years at Treasury. Many accused him of siding too closely with Wall Street in the government bailout of the financial system.

As the administration's highest-profile economic figure, Geithner been a lightning rod for criticism of its economic stewardship. Critics contend that government spending under Obama failed to keep unemployment from rising and gave the country record budget deficits.

But Geithner also received praise for his leadership in getting a sweeping financial overhaul through Congress and in the efforts he made to stabilize the financial system

Geithner's supporters also argue that the Treasury secretary provided Obama with sound advice on how to restructure the financial system. They note, too, that he successfully managed the government's $700 billion financial bailout to limit taxpayers' losses.

In the interview Wednesday, Geithner offered no hints of what he might do after leaving the administration.

"I'm very fortunate," he said. "I work with tremendously talented people, and this is one of the most important times in modern history to be in the world of economic policy and finance. And I work for a great president, who I believe in."

It isn't unusual for Cabinet secretaries to leave after just one term of a two-term presidency. George W. Bush and Bill Clinton both had three Treasury secretaries during their two terms in office.

The only Treasury secretary in recent history to serve more than four years was Nicholas Brady who served as Ronald Reagan's third Treasury secretary. Brady then stayed to serve for all four years of the George H.W. Bush administration.

Occupy movement gets help from its musical friends (Reuters)

NEW YORK (Reuters) ? Yoko Ono, Debbie Harry, Jackson Browne and Willie Nelson are among dozens of artists contributing to "Occupy This Album," to raise money for the Occupy Wall Street movement against economic inequality, a publicity firm said on Monday.

Workhouse public relations firm said that the album would be released in the spring "as a celebration that provides a musical voice and ultimately through record sales, financial support to fortify the movements continuation."

The album is being put together by Occupy Wall Street solidarity group "Music for Occupy." Other artists involved with the album are Third Eye Blind, Crosby and Nash, Tom Morello, Thievery Corporation, Warren Haynes, and Immortal Technique.

Inspired by the Arab Spring protests, Occupy Wall Street began when protesters set up camp in New York's Zuccotti Park on September 17, sparking demonstrations across the United States and elsewhere in the world.

But the eviction of protesters in New York and public spaces in other U.S. cities in November and December has made the protests less visible and organizers now face the challenge of how to maintain momentum without the physical camps.

Protesters are upset that billions of dollars in bailouts given to banks during the recession allowed a return to huge profits while average Americans had no relief from unemployment and a struggling economy. They also believe the richest 1 percent do not pay their fair share of taxes.

Seal, Heidi Klum announce separation (AP)

NEW YORK ? Seal and Heidi Klum have announced that their storybook marriage is coming to the end of the runway.

In a statement Sunday night, the power couple announced their separation after rumors swirled over the weekend that a divorce was imminent.

"While we have enjoyed seven very loving, loyal and happy years of marriage, after much soul searching we have decided to separate," the joint statement read. "We have had the deepest respect for one another throughout our relationship and continue to love each other very much, but we have grown apart. This is an amicable process and protecting the well-being of our children remains our top priority, especially during this time of transition. We thank our family, friends, and fans for their kind words of support. And for our children's sake, we appreciate you respecting our privacy."

The couple married in 2005 and has four children together, including the supermodel's daughter from a previous relationship.

They were one of Hollywood's most high-profile couples, and seemed to have the relationship everyone should envy. They two starred together in the music video "Secret," they renewed their wedding vows each anniversary, boasted of their love in the media, and threw Halloween bashes together where they dressed in outrageous outfits, most recently last year in New York City, where the two engaged in their typical public display of affection for the cameras.

In an interview with The Associated Press in 2007, the "Kiss from A Rose" singer described his wife, who has a tattoo of his name on her arm, as his best friend.

"It is really important that we have that understanding because apart from anything else it is really healthy," he said of the "Project Runway" host. "People often talk about the most important thing in a relationship. They say it is really important that you are turned on by your partner and you love each other, which is all really true.I often think that the most important thing or certainly up there with love is respect."

TMZ first reported on Saturday that the two planned to divorce this week.

His announcement comes as he releases his new album, "Soul 2," on Tuesday, which has songs like "Love T.K.O," "Let's Stay Together" and "Love Don't Live Here Anymore."

Genzyme, Veracyte Strike Deal to Market Thyroid Cancer Diagnostic ...

Veracyte has been gaining momentum the past few months with a?new molecular diagnostic for thyroid cancer, and today it?s taking another step ahead by forming an alliance with Genzyme, the maker of a?common drug for treating the?disease.

South San Francisco-based Veracyte said today that it has formed a?global co-promotion deal with Genzyme, the Cambridge, MA-based unit of Sanofi, in which the bigger company will start marketing Veracyte?s Afirma test. Financial terms of the deal aren?t being?disclosed.

Veracyte, which was featured here in November, has been selling a?gene expression test over the past year to help doctors determine when a?lump in the thyroid gland is benign, or potentially malignant. Almost 500,000 suspicious thyroid lumps get biopsied in pathology labs every year, and about 20 to 30 percent of those tests offer ?inconclusive? results. Fearing the worst, many of those patients go on to have surgery to remove their thyroid glands at a?cost of about $12,000 to $16,000 apiece, plus a?lifetime of thyroid hormone medications.

Veracyte?s proposition to doctors is that by doing a?standard fine-needle biopsy test, and paying $3,500 for Veracyte to perform its Afirma gene expression analysis, they can rule out malignancies early in the game. That is supposed to cut down on unnecessary surgeries, and save insurers some money. Earlier this month, a?Medicare contractor that covers 40 million people said it has agreed to cover the?test.

Genzyme has long had interest in the thyroid cancer field, through its marketing of thyrotropin alfa (Thyrogen). ?Together, our products offer patients and physicians a?powerful personalized medicine solution for the diagnosis and treatment of thyroid cancer, addressing an unmet need in the community and improving patient outcomes,? said Genzyme?s head of rare diseases, Rogerio Vivaldi, in a?statement.

Since I?ll pay a month for Hazard Insurance (about to close on the house).

1/ Do I have to buy Homeowner insurance or not? Is Homeowner Insurance required by mortgage lender? I thought that what Haz Insurance is for in case of ?..

2/ If Homeowner insurance is required. Then do I have the right to buy premium just for the cost of rebuilding the house only, instead of the loan amount?

Please provide any tips and experience that a new homeowner would need.

At each Consumer Electronics Show, there seems to be at least one gadget type which just plain takes over the place. Two years ago it was e-ink readers, now practically invisible on the show floor. Last year it was the 3-D TV. This year, Android tablets are all the rage.?Yes, there were so many Android tablets this year that some of us started to become slightly queasy each time yet another such device was announced.

Was the revulsion justified? Or does this latest batch of Android devices stand a chance to succeed? Let's talk tablets!

Pantech

Pantech Element
The Pantech Element?is a fun (not-so-little) 8-inch tablet. It has a 1.5GHz processor, 16GB of memory, (which can be expanded up to 32GB thanks to a microSD slot), a 5-megapixel rear-facing camera, and a 2MP front-facing camera.?It'll run on AT&T's 4G LTE network, so it should be pretty darn speedy.

Oh, and did I mention that the Element is waterproof??The gadget can apparently be submerged in one meter of water for up to 30 minutes without any troubles. In theory, this means that you wouldn't have to worry if you ever spill coffee onto the tablet.

Toshiba Excite X10
One of my favorites?in the latest Android tablet batch ? appearance-wise, at least???is the Toshiba Excite X10.?This particular gadget has been available in other countries for a while, but it's finally coming to the U.S. soon. It's an eye-catching 10-inch beauty which measures in with a thickness of only 0.3 inches.

The X10's display is covered in super tough Corning Gorilla Glass and behind it there's a?Texas Instruments OMAP 4430 processor (that's 1.2 GHz of horsepower), 16GB or 32GB of storage (depending on your choice of configuration), a 2MP front-facing camera, a 5MP rear-facing camera (with an LED flash), and an assortment of ports including Micro USB and Micro HDMI. There?are also a gyroscope, an accelerometer and GPS capabilities as well as eCompass and ambient light sensors.

The Toshiba Excite X10 will set you back $530 if you're getting the 16GB model and $600 if you opt for the 32GB version. It should become available in the first quarter of 2012.

With its rather reasonable $249 pricetag, the Asus Eee Pad MeMO 370T ? try wrapping your tongue around that name???is far too tempting of a device.?It's a 7-inch gadget, has a 1.2 GHz Nvidia Tegra 3 processor on the inside, pen-input on the outside, and a 5MP camera in the back.

As its name might suggest, the Samsung Galaxy Tab 7.7 is the big brother of the Galaxy Tab 7.0 Plus.?It's a ???wait for it ???7.7-inch device and it?has a 1280 x 800 Super AMOLED display, a 1.4 GHz dual-core processor, a 3MP rear-facing camera, a 2MP front-facing camera, and the usual assortment of ports.

It's very much worth noting that the Tab 7.7 is?going to offer 4G LTE connectivity through Verizon Wireless. (Oh, yes! That's speedy.)

Oh, what a tease Acer can be! The company briefly showed off the?next-generation Iconia Tab tablet during a CES press conference and it certainly caught my attention.?The gadget is a quad-core device with a lovely 1080p screen and a?Nvidia Tegra 3 processor.

Not too much is known about this particular tablet at the time, but it's definitely a powerful little beast.

Wait! What's the problem here?
The trouble with most of the tablets presented lately is not the hardware but the software. Time after time the same lines keep appearing in press releases. The devices are "ready" for Android 4.0, but shipping with Honeycomb 3.2, in other words "last year's OS." Their makers promise that the hardware will be updated to Ice Cream Sandwich shortly after launch, software updates are coming, pinky swear, cross our hearts and hope to die, but even the manufacturers don't necessarily have a firm grasp of the upgrade timing.

The reality is that customers are often left waiting for their new toys to actually feel new?? to receive the latest and greatest in Android software. And perhaps I'm simply a spoiled iPad user, but to me that seems unacceptable. Many Android tablet makers have the hardware handled and are handing out mind-blowing spec sheets ??but until they give their devices brains to match their guts, I'm saying "no dice."

The moment Android tablets take a page from the Apple manual and start selling the experience and the?? get ready to cringe?? magic of software and apps, the moment that developers feel that the time is right to launch an all-out Android tablet software assault, the moment that together, both hardware makers and software developers showcase what you can do with these things, rather than just throw around spec sheets, that's when these new tablets will succeed.

SOPA Question Presented To Candidates At Republican Debate (VIDEO)

In a sign of just how dramatically public opinion has swung against the Internet anti-piracy legislation up for a vote next week in the Senate, all four GOP candidates said at Thursday evening's primary debate they opposed it, though Rick Santorum seemed, entirely unsurprisingly, the least comfortable with the notion that, as he put it, "anything goes" on the Internet. (Google it.)

"I favor freedom. I think that we have a patent office, we have copyright law," said Newt Gingrich, rejecting "the idea that we're going to preemptively have the government start censoring."

Mitt Romney agreed. "I think he got it just about right," he said, calling the Stop Online Piracy Act (SOPA) "far too intrusive, far too expansive," and worrying that it could have "a potentially depressing impact" on the growth and development of the Internet.

"If we can find a way to very narrowly go after pirating," said Romney, "we should do that."

Ron Paul noted that he was the first Republican to oppose the bill in the House. He said he was pleased to hear establishment Republicans coming around to his position. "Republicans unfortunately have been on the wrong side of this issue," he said.

Santorum, meanwhile, seemed to be penned in by the unanimous opposition. "I agree with everybody up here that it goes too far," he said, before launching into a defense of regulating the Internet in order to attack piracy. "I'm for free, but I'm not for people abusing the law and I think something proper should be done," he said.

Panel backs U.S. finding on Toyota, recommends steps (Reuters)

WASHINGTON (Reuters) ? A scientific panel backed a U.S. government finding that electronic software played no role in sudden acceleration of Toyota vehicles, but the group questioned the ability of regulators to investigate similar, complex cases on their own in the future without improving their technical expertise.

The National Research Council's Transportation Research Board report released on Wednesday effectively concluded the sweeping federal investigation into the recalls of 8 million Toyota and Lexus cars and trucks in 2009 and 2010.

"I think it does close the book. I think it sustains the work that we did and verifies the work that we did," Transportation Secretary Ray LaHood said on the sidelines of a conference in Washington.

LaHood sought the independent report from academic, industry, scientific and regulatory experts as a follow-up to the overarching Toyota investigation by the National Highway Traffic Safety Administration, with help from technical experts at NASA.

NHTSA came under fire in 2010 from Congress and consumer and safety groups, who complained that it for years underreacted to complaints about sudden acceleration in Toyota vehicles and pressed for recalls only after a deadly California crash and other questions surfaced about oversight.

NHTSA investigators tied sudden acceleration recalls to loose floormats that could jam the accelerator and gas pedals that did not spring back as designed. However, questions persisted about whether potential faults in Toyota electronic throttles were also a factor.

NHTSA and NASA subsequently determined jointly last February that throttles played no role in the Toyota case and said driver error would likely explain most sudden acceleration incidents beyond the already identified equipment and mechanical flaws.

The conclusion spared Toyota from the possibility of new recalls and additional questions about the safety of its products.

The Research Council review supported the thoroughness and conclusions of the joint agency investigation based on the information that was available to analyze.

"The committee finds NHTSA's decision to close its investigation justified on the basis of the agency's initial defect investigations, which were corroborated by its follow-up analyses of thousands of consumer complaints, examinations of event data recorders in vehicles suspected to have crashed because of unintended acceleration, and the results of NASA's study," the research council members said in their final report.

But the scientific group did not dismiss the possibility of safety related glitches occurring in electronic systems now ubiquitous in car design industrywide, saying such events would leave no evidence that they occurred.

Moreover, the researchers said it was troubling that NHTSA could not answer questions about sudden acceleration without outside help and said it was crucial it develop the expertise to do so on its own.

"As more complex and interacting electronics systems are deployed, the prospect that vehicle electronics will be suspected and possibly implicated in unsafe vehicle behaviors increases," the panel said.

The group recommended that NHTSA convene a standing technical committee to advise on issues involving electronics and review its technological needs for new resources.

Toyota did not address the research council findings directly, but said in a statement the group's work was valuable.

The company said it would work with regulators and Congress to address the report's recommendations to strengthen NHTSA understanding of vehicle systems and its oversight of the industry.

The panel also supported NHTSA's efforts to make electronic recording devices mandatory on all new cars and trucks and its research on new accelerator pedal designs and keyless ignitions. All were factors in the Toyota investigation.

Toyota still faces hundreds of lawsuits in the recall cases.

Oil price drifts lower, stays above $100 a barrel

The price of benchmark U.S. oil ended a little lower on Thursday following a series of economic reports that pointed to an improving U.S. economy.

Jobless claims fell, consumer prices were steady and the dismal home construction market showed more signs of life at the end of 2011.

A stronger economy means demand for energy products should improve. However analysts say oil prices will continue to swing between gains and losses until there is more certainty about the direction of the global economy.

Benchmark oil fell 20 cents to finish at $100.39 per barrel in New York on Thursday. It was as high as $102.06 earlier in the day. Brent crude, which is used to price many varieties of foreign crude sent to U.S. refineries, rose 89 cents to end at $111.55 per barrel in London.

The Labor Department said the number of people seeking unemployment benefits fell last week to the lowest level since April 2008. The drop is more evidence of a strengthening job market. A department spokesman said that the number can be volatile this time of year because it reflects temporary hires in the holiday season.

The government also reported that consumer prices were unchanged last month, as the inflation rate remains at a low.

Builders began construction on nearly 607,000 homes last year. That is about half of what economists say is needed for a healthy market. The numbers rose over the course of 2011, raising expectations that the collapse of the housing industry has at last hit bottom.

The Energy Department said Thursday that the nation's crude oil supplies declined about 1 percent last week. Gasoline supplies rose 1.7 percent and demand over the past four weeks is down 6.1 percent from a year ago.

Worries about Europe's debt crisis and future energy demand receded as France and Spain staged successful bond auctions, indicating that investors have not been scared off by S&P's recent downgrades of eurozone countries.

Gas pump prices in the U.S. are at the highest level they've ever been for this time of year. The national average remained at $3.38 a gallon on Thursday, according to AAA, Wright Express and OPIS. That's about 17 cents more than a month ago and 27 cents more than a year ago.

Fred Rozell, retail pricing director at Oil Price Information Service, expects gasoline prices to be around $4 a gallon by spring.

Natural gas prices dropped again on Thursday, after the Energy Department said the nation's supplies fell last week but remained nearly 21 percent above the five-year average. Consumers, utilities and businesses are using less natural gas this winter because of persistent above-average temperatures across much of the nation. Natural gas futures fell 15 cents, or 6.1 percent, to finish at $2.32 per 1,000 cubic feet.

Heating oil rose 2 cents to end at $3.04 per gallon and gasoline futures fell 1 cent to end at $2.82 per gallon.

Colbert's Super PAC ad attacks ... Colbert

?The 2012 presidential campaign: It just keeps getting better and better. Or, depending on your perspective, weirder and weirder.

First, the Super PAC formerly run by "The Colbert Report's" Stephen Colbert (and now overseen without any coordination whatsoever by "The Daily Show's" Jon Stewart) released a new attack ad yesterday -- against Colbert!

Yes, that's Samuel L. Jackson appearing in the voiceover, asking important questions about the talk show host like, "And come on, why is the 'T' in his name silent? What else is he silent about? Letting murderers out of jail?"

Jackson then launches into a "Snakes on a Plane"-esque tirade: "Enough is enough! I have had it with these money-grubbing Super PACs messing with our money to buy the elections!" before endorsing Herman Cain for president.

Herman Cain? He dropped out of the race, didn't he?

Well, yes. But that doesn't mean he's gone for good: Last night, Colbert announced on "The Colbert Report" that he will hold a rally on Friday in South Carolina, one day before the primary featuring special guest ... Herman Cain!

In support of their non-candidacies, the event, entitled "The Rock Me Like a Herman Cain: South Cain-olina Primary Rally" is set to take place at 1 p.m. at the College of Charleston. ??There will be speeches, there will be?cheerleaders, there will be?a marching band and a gospel choir. ??

Colbert promised this rally will be better than the "Rally to Restore Sanity and/or Fear" (because, as he said, Jon Stewart won't be there). ??

In a release from Colbert's "campaign" as seen on Buzzfeed, Colbert explained, "Herman is the only former candidate who truly shares my values. It's like our values were separated at birth. And our ethics are at least first cousins." ??

He then went on to say?he?wanted ?all undecided voters to vote for Cain" and ?9-9-9.? ?? ?

Kathy Hoekstra, Cain's Director of Media Relations, told Fox News yesterday that Colbert's people "got in touch" with the Cain camp last week to alert them of something happening soon. She confirmed Cain?would be taping a segment with Colbert on Friday in South Carolina.

No word yet on whether Cain will sing during that segment. But that's something people would probably vote for.

Waltrip headlines NASCAR's 3rd Hall of Fame class (AP)

CHARLOTTE, N.C. ? Darrell Waltrip was nicknamed "Jaws" as a driver for his outrageous trash-talking. His loquaciousness launched his second career, as one of NASCAR's most recognized ? and outspoken ? television analysts.

But on the eve on his induction into the NASCAR Hall of Fame, `ol DW has no idea what he's going to say in Friday night's ceremony.

"I've written 10 speeches and after the 10th one, I threw it away, and said `I can't write a speech,'" Waltrip said. "I'm pretty spontaneous, so I'm just going to get up and say what I think and hope it's the right thing."

Waltrip hasn't always said the right thing in a career that dates back to his 1972 debut in NASCAR's top series. He angered his rivals as a driver, and his strong opinions as an analyst for both Fox Sports and Speed have made him one of the more polarizing commentators in NASCAR.

Some might even think it cost him a shot in last year's voting, when despite three championships and 84 victories, Waltrip was shut out of the second Hall of Fame class. Waltrip had signed on with Speed as an analyst for voting day, and from his perch on the stage at the back of the Great Hall, his face couldn't hide his heartbreak over not making the second class.

He tried not to get his hopes up this time around, but everybody knew how badly Waltrip wanted to be included in the third class. Brian France called his name last June, Waltrip rushed onto the podium and kissed the NASCAR chairman.

Waltrip goes into the Hall of Fame with three-time champion Cale Yarborough, NASCAR modified great Richie Evans, innovative crew chief Dale Inman and Glen Wood, one of NASCAR's original team owners.

The show will belong to Waltrip, though, who knew as a child he wanted to be an entertainer and found a way to incorporate his desire to perform into his NASCAR career. He was brash and bold and loved being in front of the cameras.

His style, his showmanship, was like nothing NASCAR had ever seen before and paved the way for more personality from the drivers.

"I always thought it would be fun to be an actor, or a comedian, but I guess race car driving suited me," he said. "I like to make people laugh, which is better than making them cry, right? Some people take the path of least of resistance, but I take the path I couldn't resist. I looked at everything I did, what if I did everything that everybody else is doing as they go down that path.

I figured there's a lot more room going in this other direction then there is in that direction with all the other guys who chewed Skoal and wore belt buckles and cowboy hats. I'm not making fun of them, I just chose not to go down that route, to be more upscale, in a class by myself. I was a Penske guy living in an Earnhardt world."

He will be again on Friday night when his larger-than-life personality is sure to outshine Yarborough, Inman and Wood. Evans, winner of nine NASCAR national modified championships over a 13-year span, was killed in a 1985 accident at Martinsville Speedway. He was 44.

Yarborough from 1976-78 became the first driver in NASCAR history to win three consecutive championships, a record that stood until Jimmie Johnson's run of five-straight titles. He finished second in the standings another three times, and ended his career with 83 victories ? sixth on the all-time list.

Yarborough was a four-time Daytona 500 winner, but decided in 1980 to run only partial schedules for the final nine years of his career.

"I realized I had three daughters growing up and I was away from them all the time," he said. "Even though racing was very important in my life, I felt like they were a little more important so I was going to spend some more time with them and be with them in their growing-up years. There's no telling how many wins I left on the table, but I definitely made the right decision."

Inman led his cousin, Hall of Famer Richard Petty, to a record seven championships. The crew chief won an eighth title with Terry Labonte. From 1958 to 1992, he led drivers to 193 wins and 129 poles.

His standout year was 1967 when he guided Petty to a NASCAR-record, 27 races ? including 10-straight ? in a single car built a year earlier.

"Dale was a racing benchmark," Petty said. "He was the sport's first official crew chief and people modeled themselves after him. He knew what, when and where ? and when he made a mistake he wasn't afraid to admit it. Everyone respected him for that. Nobody even comes close to the number of wins that Dale has recorded."

Wood, at 86 the oldest member of this incoming class, formed a race team that still competes today in Stuart, Va., with his four brothers. Trevor Bayne won the Daytona 500 last year for the Wood Brothers, giving the team its 98th victory spanning seven different decades. Bayne's win was the team's fifth Daytona 500 victory, and the Wood Brothers also won the 1965 Indianapolis 500 with Jim Clark.

Wood's brother, Leonard, choreographer of the modern pit stop, is a NASCAR Hall of Fame nominee.

"It's such a long trip from 1950 to now. It's sort of hard to believe," Wood said. "It's one of the biggest honors you could have. I didn't come here alone; I had a lot of help. There's five of us brothers. All of those helped at one time or another."
